WWL-TV in New Orleans reports the Alabama fan accused of performing a sex act on a passed out LSU fan at a fast food restaurant has been indicted by a grand jury.
The grand jury formally charged Brian Downing, 32, of Smiths Station, AL with sexual battery and obscenity.

Most normal Bama fans were horrified and embarrassed by the video shown in the days following Alabama's BCS Championship win over SEC West rival LSU. That wasn't winning with class or acting like you'd been there before.
That said, occasional co-blogger and legal analyst G-MAN opined that the case wasn't worth taking to trial. An Orleans Parish grand jury disagreed and indicted Brian Downing on a felony count of sexual battery. In all likelihood, Downing's counsel will negotiate a plea deal and hope to avoid serious jail time for their client.
Let it be said clearly and openly: People like Brian Downing and Harvey Updyke do not represent the majority of Tide fans. You meet that majority on The Quad before a big home game. You meet the Downings and Updykes on radio talk shows.
